This Legal Notice governs the use of the Fotolista.es website (hereinafter, "the website"). Fotolista.es is operated from Spain, and this notice reflects the requirements of Spanish law, in particular Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (LSSI-CE). Spanish law applies regardless of the country you access the site from.

Fotolista.es offers users a tool that, from a photo of an item, uses artificial intelligence to generate a title, description, estimated condition, indicative price and keywords for listing on second-hand marketplaces such as Wallapop or Vinted. The service requires a user account and combines a free plan with a paid plan (Fotolista Pro).

Accessing and using the website makes you a user and implies full acceptance of the provisions in this Legal Notice, the Privacy Policy and, where applicable, any specific terms that may apply.

3. Terms of access and use

• Use of the website requires creating a free account with an email and password. The free plan includes a limited number of generations per month; for more volume or extra features (such as uploading several photos at once) there is a paid plan, Fotolista Pro.
• The user agrees to make appropriate and lawful use of the website, in accordance with applicable law, this Legal Notice, and generally accepted standards of conduct and good practice.
• Using the website for unlawful purposes, purposes that infringe third-party rights, or in any way that could damage, disable or overload the service (including automated or abusive use of the listing generator) is prohibited.
• Results generated by the artificial intelligence (titles, descriptions, prices and keywords) are indicative suggestions. The user is solely responsible for reviewing, editing and validating this content before publishing it on any platform.

4. Intellectual and industrial property

The website's design, source code, logos, trademarks and other graphic elements belong to Fotolista.es or to third parties who have authorised their use, and are protected by intellectual and industrial property law. Their reproduction, distribution or transformation without express authorisation is prohibited.

You retain all rights over any images you upload to the service. These images are used exclusively for AI analysis and are not stored on Fotolista.es servers (see Privacy Policy).

5. Disclaimer of warranties and liability

• Fotolista.es does not guarantee the accuracy, truthfulness or commercial suitability of titles, descriptions or prices generated by the artificial intelligence. These are automatic suggestions that may contain errors.
• Fotolista.es is not responsible for any listings you publish on Wallapop, Vinted or other platforms using the generated content, nor for any consequences arising from those listings.
• Fotolista.es does not guarantee continuous availability of the service and is not liable for interruptions, technical errors or failures caused by third parties (including the AI provider used).

6. Third-party links

The website may contain links to third-party services (WhatsApp, Gmail, Wallapop, Vinted, Google AdSense). Fotolista.es is not responsible for the content or privacy policies of these sites, which are outside its control.

7. Governing law and jurisdiction

These terms are governed by Spanish law. Any dispute arising from access to or use of the website will be subject to the competent Spanish courts, in accordance with applicable consumer protection law. This does not affect any mandatory consumer protections you may be entitled to under the law of your own country of residence.

Fotolista.es reserves the right to modify this Legal Notice to reflect legislative changes or changes to the service. The last-updated date will always be visible at the top of this page.
